By using the Website or by accepting a quotation or placing an order, you agree to these Terms. If you do not agree, please do not use the Website or our Services. Our Services are provided mainly to businesses, contractors and organisations (“you” or the “Customer”). If you are a consumer, nothing in these Terms affects your statutory rights.

2. Using our Website

The Website is provided for general information about us and our Services. You agree to use it lawfully and not to:

  • Use it in any way that breaches any law or regulation.
  • Introduce viruses, malware or other harmful material, or attempt to gain unauthorised access to the Website, our servers or any connected systems.
  • Copy, scrape, reproduce or redistribute content from the Website except as allowed by these Terms.
  • Submit false, misleading or abusive information through our forms or account features.
  • Interfere with the proper working or security of the Website.

If you create an account, you must give accurate details, keep your login credentials confidential and tell us promptly if you suspect unauthorised use. You are responsible for all activity under your account. We may suspend or close accounts that breach these Terms.

3. Website content and accuracy

We take reasonable care to keep the Website accurate and up to date, but information about our Services, equipment, capacities, specifications, availability and areas covered is provided for general guidance only and may change without notice. Nothing on the Website is a binding offer or a guarantee that equipment is available. Equipment capacities and lifting charts shown on the Website are indicative only. Each lift must be planned on the actual job details, and our written quotation and lift plan will always take priority over general Website information.

We do not guarantee that the Website will be uninterrupted, secure or error-free, and we may suspend, change or withdraw any part of it at any time.

4. Intellectual property

The Website and everything on it, including text, images, logos, graphics, photographs, design, CAD drawings and software, belongs to us or our licensors and is protected by copyright, trade mark and other intellectual property laws. You may view the Website and print or download extracts for your own personal or internal business use, provided you keep all copyright and other notices. You must not otherwise use, copy, modify or distribute our content, or use our name or logos, without our prior written permission.

Any site plans, lift plans, method statements or drawings we produce for you remain our intellectual property but you may use them for the job they were produced for.

5. Enquiries, quotations and orders

Enquiries. Sending an enquiry through the Website, by email or by telephone is not an order and does not create a contract.

Quotations. A quotation is an invitation to order and is valid for 30 days from its date unless it says otherwise. We may withdraw or change a quotation before you accept it. Quotations are based on the information you give us (including the load, weights, dimensions, lift radius, site access, ground conditions and dates), so you must make sure that information is complete and accurate.

Orders and contract. A contract is formed when we confirm your booking in writing (including by email) or begin the Services. Any variation must be agreed in writing by us. These Terms, together with our quotation and booking confirmation, form the whole agreement and replace any terms you may try to apply, including terms on your purchase orders.

Price changes. If the scope of work, hire period, site conditions, load or access differ from the information provided, we may revise the price. Extra time, standby, waiting, return trips, additional equipment, extra personnel and out-of-hours work will be charged in addition at our then-current rates.

6. Provision of services and hire

Dates and times. Any dates or times are estimates. We will use reasonable efforts to meet them but time is not of the essence. We are not liable for delay caused by matters outside our reasonable control, including adverse weather, traffic, breakdown, site delays, access problems or late changes by you.

Operators and equipment. Cranes, vehicles and lifting equipment are supplied with operators, appointed persons, slingers or signallers where agreed. Unless the quotation clearly states otherwise, services are provided on a contract lift or managed basis in line with the Lifting Operations and Lifting Equipment Regulations 1998 (LOLER) and the Provision and Use of Work Equipment Regulations 1998 (PUWER). Where we supply crane and operator only on a hire basis, you must make sure that the lift is planned, supervised and carried out by a competent appointed person unless we have agreed to provide one in writing.

Hire period. Hire runs from when the equipment leaves our depot (or the agreed starting point) until it is returned or until the job is complete and the equipment is released, whichever applies. Minimum hire periods, travel time and standby time may be charged.

Use of equipment. If you hire equipment without an operator, you must use it only for its intended purpose, only with competent and trained persons, within its safe working load and manufacturer instructions, and in line with all laws and regulations. You must not sub-hire, lend, move or modify it without our consent and must keep it safe, secure and insured while it is in your care.

7. Site requirements and Customer responsibilities

You must, at your own cost:

  • Provide safe, clear and legal access to the site for our vehicles, cranes and personnel, including any road, pavement, structure, drain, cellar or underground service that might be affected.
  • Prepare and maintain firm, level ground suitable for outriggers and crane loads, and tell us about any known ground hazards, underground services, overhead cables, voids, slopes or weak areas. You are responsible for ground bearing capacity and any damage to the ground, surfaces, kerbs, drives or services caused by loads, outriggers or vehicles, unless caused by our negligence.
  • Obtain all permits, licences, road closures, parking suspensions, oversail licences, permissions and consents needed for the work, unless we have agreed in writing to arrange them.
  • Give us accurate and sufficient information about the load, including its weight, dimensions and centre of gravity.
  • Provide site inductions, relevant site rules, risk information and a safe place to work, and comply with health and safety law.
  • Make sure that our operators and personnel are not required to carry out work outside their normal duties or for which they are not trained.

Our operators may refuse to carry out or stop any lift that they believe to be unsafe, and we are not liable for any resulting delay or cost. Any resulting standby, aborted visit or abortive costs may be charged to you.

8. Traffic management, CAD site plans and other services

Where we supply traffic management, CAD site plans, crane staff or other specialist services, we will provide them using reasonable skill and care in line with the information you give us. You remain responsible for confirming that any plan or arrangement is suitable for your project and for obtaining any approval from the highways authority, local authority, client or other relevant party. Plans and drawings are produced for the stated site only and must not be reused for other work without our consent.

9. Prices and payment

All prices are in pounds sterling and exclude VAT, which will be added at the applicable rate, unless stated otherwise. Unless we agree credit terms in writing, payment is due in cleared funds before the Services are carried out or on completion. Where we agree credit terms, invoices must be paid in full within 30 days of the invoice date, without deduction, set-off or counterclaim.

If you pay late, we may charge interest at 8% a year above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998, plus statutory compensation and reasonable recovery costs, and we may suspend Services and withdraw credit. If you dispute part of an invoice, you must tell us in writing within 7 days of receipt and pay the undisputed part by the due date.

10. Cancellation and postponement

If you cancel or postpone a booking, you must tell us in writing as soon as possible. Unless we agree otherwise, the following may be charged:

  • More than 48 hours before the scheduled start: no charge, other than any costs we have already incurred for third parties or special arrangements.
  • Between 24 and 48 hours before the scheduled start: 50% of the quoted price.
  • Less than 24 hours before the scheduled start, or if we arrive on site and cannot proceed for reasons outside our control: 100% of the quoted price, plus any extra costs we reasonably incur.

We may cancel or postpone a booking without liability if equipment, operators or vehicles are unavailable, if conditions are unsafe, or if events outside our reasonable control prevent us from carrying out the Services. In those cases we will offer a new date where possible and will refund any sums paid in advance for Services we do not provide.

If you are a consumer, you may have additional statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. These do not generally apply to services booked for a specific date, once performance has started with your agreement.

11. Damage, loss and insurance

You must tell us immediately of any damage to, loss of or accident involving our equipment, vehicles or personnel. If you hire equipment without an operator, you are responsible for loss of or damage to it while in your possession, other than fair wear and tear, and for third-party loss caused by its use. You must keep it adequately insured. Under all arrangements you are responsible for the safety and condition of the load, the structure being lifted from or onto, and the site.

We hold public liability and other insurance appropriate to our business. Details of our cover are available on reasonable request, and we can provide evidence of insurance to you or your client where needed.

12. Our liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded.

Subject to this, and to the extent the law allows:

  • We are not liable to business customers for any loss of profit, revenue, business, contracts, goodwill or anticipated savings, nor for any indirect or consequential loss, however arising.
  • Our total liability to you for all claims connected with a particular contract, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the total price paid or payable for the Services under that contract or the amount we recover under our insurance for that claim, whichever is the greater, subject to a maximum of £5,000,000 for any one event.
  • We are not liable for any loss or damage resulting from inaccurate information given by you, from your failure to comply with these Terms, from ground conditions or concealed services, or from events outside our reasonable control.
  • We are not liable for any loss caused by viruses, interruptions or errors on the Website, and we provide the Website on an “as is” basis.

Any claim must be notified to us in writing within 14 days of the Services being supplied, or of the date you first became aware of the issue, if later, and proceedings must be started within 12 months.

13. Health and safety

We take health and safety seriously. All parties must comply with all relevant health and safety legislation, including the Health and Safety at Work etc. Act 1974, LOLER, PUWER, the Construction (Design and Management) Regulations 2015 and BS 7121 (safe use of cranes). We will provide, or you must request, risk assessments and method statements where needed, and you must review them and give us any information we need to carry out the work safely. Our personnel are entitled to follow our own safety policies and may stop any activity they consider unsafe.

14. Termination

We may suspend or terminate a contract or your use of the Website immediately by written notice if you fail to pay on time, breach these Terms, become insolvent, or if we reasonably believe the equipment or our personnel are at risk. On termination, you must pay all sums due up to the date of termination and return any of our equipment promptly.

15. Force majeure

Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including severe weather, flooding, fire, strikes, pandemic, road closures, government action, supply shortages, vehicle breakdowns or failure of utilities. If the event continues for more than 30 days, either party may terminate the affected booking on written notice, and you will pay for Services already provided.

16. Confidentiality and data protection

Each party must keep confidential any non-public business information received from the other and use it only for the purposes of the contract, unless disclosure is legally required. We use your personal data in line with our Privacy Policy and Cookie Policy, which form part of these Terms.

17. Links and third-party sites

The Website may link to third-party sites, including social media pages, our website developer and map services. These are provided for convenience only. We do not control and are not responsible for their content, availability or policies, and linking is not an endorsement.

18. Complaints

If you are unhappy with any aspect of our Website or Services, please contact us at hiredesk@thanetcranehire.co.uk or on 01622 858200 or 01842 790011, giving as much detail as possible. We will acknowledge your complaint promptly, investigate it and aim to respond within 14 days.

19. General

  • Entire agreement: these Terms, with your booking confirmation and quotation, are the entire agreement between us on their subject matter.
  • Changes: we may update these Terms at any time. The version on the Website on the date you use it, or the version in force on the date of your booking, applies.
  • Assignment and subcontracting: we may subcontract or transfer our rights and obligations. You may not do so without our written consent.
  • Severability: if any provision is found to be invalid or unenforceable, the rest will continue in force.
  • Waiver: a delay or failure to enforce a right is not a waiver of it.
  • Third-party rights: no one other than you and us has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
  • Notices: notices must be in writing and sent to the other party’s address or email address given in the booking.

20. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes), are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer living in Scotland or Northern Ireland you may also bring proceedings in your local courts.
